Terms of Service.
These Terms of Service ("Terms") govern your use of Novenabeat (the "Service"), a web application provided by Onarvo Ltd, a company registered in England and Wales ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Novenabeat generates audible sine wave tones at the nine Solfeggio frequencies (174, 285, 396, 417, 528, 639, 741, 852, and 963 Hz) and offers a Binaural beat mode and a session builder for sequencing meditations. The Service runs in your web browser; no account, sign-up, or download is required at this time. The Service is currently provided free of charge.
2. Eligibility
You must be at least 16 years of age to use the Service. If you are under 16, please use the Service only under the supervision of a parent or guardian.
3. Health and Safety
Novenabeat is a meditation and relaxation aid. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any condition. You use the Service entirely at your own risk.
You agree not to use the Service:
- While driving, operating heavy machinery, or undertaking any activity requiring full attention;
- At a volume that causes discomfort or risks hearing damage — keep volume moderate, particularly in Binaural mode;
- If you have a history of seizures, photosensitive epilepsy, severe tinnitus, hyperacusis, an implanted electronic medical device, or any condition that may be affected by audio stimulation, without first consulting a qualified medical professional;
- As a substitute for medical advice, diagnosis, or treatment.
4. Intellectual Property
The Novenabeat name, brand, design, code, copy, and audio synthesis logic are owned by Onarvo Ltd and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. You may not copy, modify, redistribute, reverse engineer, scrape at scale, or build derivative or competing products from the Service without our prior written consent.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law;
- Interfere with or disrupt the Service or the servers and networks that host it;
- Use automated tools to access the Service in a manner that imposes an unreasonable or disproportionately large load;
- Misrepresent your affiliation with Onarvo Ltd or with the Service.
6. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, nor do we make any claims about the physiological, psychological, or spiritual effects of any frequency or sound produced by the Service.
7. Limitation of Liability
To the maximum extent permitted by law, Onarvo Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of the Service.
Nothing in these Terms shall limit or exclude any liability that cannot be limited or excluded by applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
8. Changes to the Service and to these Terms
We may update, modify, suspend, or discontinue any part of the Service at any time without notice. We may also revise these Terms; the "Last updated" date above reflects the most recent revision. Your continued use of the Service after a change constitutes acceptance of the revised Terms.
9. Governing Law and Jurisdiction
These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over such disputes, save that nothing in this clause shall limit a consumer's right to bring proceedings in the courts of their habitual residence where required by applicable consumer protection law.
